Time at large is an arguement, brought by the Contractor not to apply liquedated damages.
Time at large situation happens when the time for completion is not mentioned in the contract or time for completion clause is no more valid.
There are some major situations in the construction industry where time at large is happening.
1. Project completion date is not mentioned in the contract.
In this situation, Engineer cannnot imply liquedated damages for any reason as there is no time for completion is mentioned.
2. When Engineer does not adminitor the extention of time claims submitted by the Contractor.
some times Engineer reject the Extension of time claims submitted by the contractor and which are false positive. Then the contractor may demostrate that this rejection is not fair and done not for the good faith. Then the time for completion is no more valid for this contractor and Time at large situation occures.
3. When there is no Extention of time clause in the contract.
According to this situation, contractor cannot claim any extention of time claims for any of the failures of the Engineer or Employer or any force major situation. so that contractor can demostrate this and it become a time at large situation.
