Nominated
sub contractors can be identified as the contractors who are specifically refered
under the main contract of the project. That mean nominated sub contractors are
selected by the client. Therefore, once the project is awarded to the contractor,
main contractor should get the service of those nominated sub contractor to
carry out those specified works.
Therefore
there is no flexibility for the main contractor to select those nominated sub
contractors.
Even though,
main contractor can make reasonable objection to go ahead with those nominated
sub contractors based on their past experience, believing that sub contractor
is lack of financial capacity and qualification to carry out the work, if the
sub contractor does not agree to indemnify the contractor against and any
misconduct by the nominated sub contractor.
In general
practice, nominated sub contractors are appointed to carry out works under
Provisional sums. Therefore, main contractor is entitled to claim attendance,
builders works and his markup on top of nominated sub contractors value of work
done.
